While the PLD generally operates on strict liability (no need to prove fault), the burden of proof shifts. If a claimant can demonstrate that a product caused damage and that the manufacturer failed to comply with specific safety requirements (like the AI Act’s requirements for data governance), the defect is presumed. This creates a strong incentive for compliance with the AI Act, as non-compliance becomes evidence of defectiveness in civil litigation.

National Implementations and Regulatory Sandboxes

While the AI Act is a Regulation (directly applicable in all Member States), its implementation relies on national authorities. Member States must designate National Competent Authorities (NCAs) and a market surveillance authority. This leads to variations in enforcement speed and resources.

For example, countries like France and Germany have already established national AI strategies and ethical guidelines, often influencing the EU-wide regulation. Regulation is increasingly focusing on interoperability to prevent vendor lock-in and ensure continuity of care. In the biotech and medical device sector, the MDR and IVDR require devices to be designed in a way that ensures interoperability with other devices and systems, where appropriate.
