When an automated system processes historical data reflecting past discrimination, it can codify and accelerate those biases at a scale and speed previously unimaginable. While not an AI-specific law, the GDPR provides crucial tools for addressing equity risks. Its principles of data minimization, purpose limitation, and accuracy are foundational. More directly, Article 22 grants individuals the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them. This is a powerful safeguard. It means that for high-stakes decisions (e.g., a loan rejection, a denial of social benefits), a human must be involved in the final decision. This “human-in-the-loop” requirement is a direct countermeasure to the opacity and potential for unchecked bias in automated systems. However, its effectiveness depends on the quality of the human review. A rubber-stamp approval of the AI’s recommendation does not fulfill the spirit of the law.

The AI Act (Regulation (EU) 2024/1689)

The AI Act is the world’s first comprehensive legal framework for artificial intelligence. It adopts a risk-based approach, categorizing systems into unacceptable, high, limited, and minimal risk. General Purpose AI (GPAI) and Systemic Risks

The Act also introduces specific rules for General Purpose AI models, such as large language models. If a model is found to present a systemic risk (i.e., a risk with a widespread impact on public health, safety, fundamental rights, or society), it is subject to additional obligations. These include conducting model evaluations, assessing and mitigating systemic risks, and reporting serious incidents. While not exclusively focused on equity, systemic risks can certainly encompass the large-scale amplification of discrimination or disinformation that could undermine democratic processes or social cohesion.

The Digital Services Act (DSA) and Algorithmic Transparency

The DSA focuses on online intermediaries but has significant implications for equity. For very large online platforms (VLOPs), it mandates transparency regarding the parameters used by their recommendation algorithms. Users must be offered a non-profiling based option for content recommendations. Beyond technical fixes, a robust governance framework is essential. The Algorithmic Impact Assessment (AIA) is a key tool. It is a structured process for identifying, assessing, and mitigating the potential risks of an AI system before it is deployed. An AIA should be a comprehensive document that considers:

  • The quality and representativeness of the data.
  • The potential for misuse or unintended consequences.

Conducting an AIA forces an organization to think critically about equity from the outset.
