Automated decision-making is no longer a theoretical risk; it is an operational reality embedded in credit scoring, hiring pipelines, insurance pricing, fraud detection, and countless other systems that process personal data at scale. For organisations deploying such systems in Europe, Article 22 of the General Data Protection Regulation (GDPR) is the central legal gatekeeper. It does not ban automated decision-making outright, but it erects strict conditions and meaningful safeguards that must be designed into the system from the outset. This article explains what Article 22 covers in practice, how the rights to information, access, and rectification interact with it, and how controllers can implement technical and organisational measures that satisfy both legal obligations and engineering constraints.
At its core, Article 22 GDPR protects individuals from decisions that produce legal effects concerning them or that similarly significantly affect them, when those decisions are based solely on automated processing, including profiling. The provision establishes a general prohibition subject to three exceptions: consent, a contract, or a Union or Member State law. Profiling is defined in Article 4(4) as any form of automated processing of personal data intended to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location, or movements.
In practice, a decision is “based solely on automated processing” when:
- The input data is processed by an algorithmic system;
- The output is generated automatically; and
- There is no meaningful human review that could alter the outcome based on additional considerations.
“Meaningful human involvement” is a key concept. A human merely rubber-stamping a pre-determined decision, without access to the underlying reasoning or the ability to consider contextual factors, is not sufficient. The European Data Protection Board (EDPB) has emphasised that the human reviewer must have the authority and competence to change the decision and must actually examine the merits in a way that can lead to a different outcome.
Legal Effects and Significant Effects
Article 22 is triggered when a decision produces legal effects concerning the data subject or similarly significantly affects them. Legal effects are relatively clear: for example, refusal of a loan, denial of a public benefit, or termination of an employment contract. Significant effects are broader and context-dependent. The UK Information Commissioner’s Office (ICO) guidance lists scenarios such as automated refusal of an online credit application, exclusion from a recruitment process, or denial of essential utilities. The EDPB and national authorities generally consider that any decision that has the potential to alter a person’s rights, opportunities, or access to essential services qualifies as a significant effect.
Notably, the threshold is not tied to the magnitude of financial loss alone. Even relatively small financial consequences can be significant if they compound or interact with other vulnerabilities. For example, repeatedly denying access to low-cost financial services can entrench exclusion. In the biotech and health sectors, decisions that affect access to care or insurance coverage based on algorithmic risk scores can have profound and lasting impacts.
Profiling Versus Decision-Making
Profiling can exist without a decision that triggers Article 22. For instance, a retailer may segment customers for marketing without making an individualised determination that affects them. However, when profiling leads to an automated refusal of service or a differential treatment that materially alters the individual’s position, Article 22 is engaged. Article 22(2)(a) allows automated decisions necessary for entering into or performing a contract with the data subject. The necessity test is strict. The decision must be objectively required to deliver the contract’s core service. For example, real-time fraud detection that blocks a payment may be necessary to protect both parties. Article 13, 14, and 15: Information and Access in the Automated Context
Articles 13 and 14 require that data subjects are informed about the existence of automated decision-making, including profiling, and the envisaged consequences. Article 15 grants the right to obtain meaningful information about the logic involved, as well as the significance and the envisaged consequences. These provisions reinforce the safeguards in Article 22 by ensuring that data subjects can understand and challenge decisions.
What “Meaningful Information About the Logic” Means
Controllers should be prepared to provide:
- The categories of personal data used;
- The main features or factors that contributed to the decision (e.g., income, payment history, behavioural indicators);

The explanation should be understandable to a non-expert while avoiding oversimplification that misrepresents the model’s operation.
Practical Approach to Access Requests
When responding to an Article 15 request in an automated decision context, organisations should:
- Confirm whether a decision was made solely by automated means;
- Provide the information required by Articles 13 and 14, if not already given;
- Explain the logic in a way that is meaningful, possibly using a standardised template;
- Offer the right to human intervention and contestation if applicable;
- Document any limitations (e.g., trade secrets) and the reasons for them, while still providing meaningful information.
It is good practice to maintain an internal “decision registry” that records, for each category of automated decision, the data sources, model type, key features, safeguards, and transparency materials. This supports both compliance and supervisory audits.
Special Category Data: Article 9 and Profiling

Processing special category data is prohibited unless a specific condition in Article 9(2) is met. In France, the CNIL has focused on algorithmic transparency and fairness, issuing guidance on profiling and automated decisions in public and private sectors, and requiring detailed information where decisions significantly affect individuals.
For cross-border lenders or payment providers, the applicable law may be that of the Member State where the controller is established (one-stop shop) or where the data subject resides, depending on the service model. It is essential to map which national provisions may apply and to ensure that the safeguards meet the strictest standard encountered in the operating footprint.
Public Sector and Social Security
Several Member States rely on Union or Member State law as the basis for automated decisions in social security, tax, and public benefits. These laws often include built-in safeguards, such as mandatory human review for adverse decisions or rights to appeal to an administrative body. Controllers in the public sector should ensure that their technical systems can produce auditable records sufficient for appeal processes and that staff are trained to intervene effectively.
Employment and Recruitment
Automated screening and ranking of candidates are common, but they are high-risk under GDPR.
