AI Policy Architecture: What Policies You Actually Need

Organisations operating within the European Union are currently navigating a complex transition period where established data protection norms intersect with the emerging, rigorous requirements of artificial intelligence regulation. The implementation of the AI Act (Regulation (EU) 2024/1689) marks a definitive shift from a voluntary, ethics-based approach to a binding legal framework. For professionals in robotics, biotech, and public administration, the era of “experimental” AI governance is over. Compliance is no longer a checklist appended to a project; it is a foundational architectural requirement of the system itself. This article outlines the essential policy infrastructure required to operationalise compliance, focusing on the minimum viable governance set: acceptable use, data governance, procurement, incident response, logging, and review procedures. It bridges the gap between high-level legal text and the practical reality of system engineering and institutional management.

The Regulatory Context: From Principles to Operational Duties

Before dissecting specific policies, it is necessary to understand the ecosystem in which they function. The General Data Protection Regulation (GDPR) established the baseline for data handling, emphasizing lawfulness, fairness, and transparency. However, the AI Act introduces distinct obligations related to the behaviour of the system, its conformity with health and safety standards, and its alignment with fundamental rights. Crucially, the AI Act is a product safety regulation as much as it is a rights regulation. It applies a risk-based approach, categorising AI systems into four risk classes: unacceptable, high, limited, and minimal. While prohibited practices (unacceptable risk) must be ceased immediately, the most significant operational burden falls on providers and deployers of High-Risk AI Systems (HRAIS). The policies discussed below are primarily designed to satisfy the strict requirements of the HRAIS category, though they represent best practice for all AI deployment.

Distinction between Provider and Deployer

A critical nuance in European regulation is the distinction between the provider (the entity developing the system or having it developed for placement on the market) and the deployer (the entity using the system under its authority). While the provider bears the heaviest burden regarding conformity assessments and technical documentation, the deployer has specific, non-transferable duties. For example, a hospital using an AI diagnostic tool (deployer) is not responsible for the system’s source code, but it is responsible for ensuring human oversight and proper usage. The policies outlined here must be adapted to the specific role of the organisation.

1. Acceptable Use Policy (AUP)

The Acceptable Use Policy is the primary governance interface between the organisation and the end-user. In the context of the AI Act, the AUP moves beyond simple prohibitions of illegal activity to become a tool for regulatory compliance. It translates the legal classification of the AI system into operational instructions.

Scope and Risk Classification

The AUP must explicitly define the intended purpose of the AI system. The AI Act is strict on this point: a high-risk AI system that is subsequently used for a different purpose automatically falls out of compliance unless re-evaluated. The policy must state, in unambiguous terms, what the system is allowed to do and, equally importantly, what it is not allowed to do. For instance, a biometric categorisation system used for access control must not be used for emotion recognition if that capability exists within the model but is not covered by the conformity assessment.

Prohibited Practices and Human Oversight Mandates

For deployers, the AUP must codify the requirement for human oversight. This is not merely a suggestion; it is a legal obligation to ensure that human operators remain aware of the risks of automation and can intervene. The policy should detail the “kill switch” mechanisms or override procedures available to operators. It must also explicitly reference the prohibitions set out in Article 5 of the AI Act (e.g., subliminal techniques, untargeted scraping of facial images from the internet). While the deployer is not responsible for the system’s design, the AUP ensures the deployer does not use the system in a prohibited manner.

Key Regulatory Insight: The “Intended Purpose” is the legal anchor of the AI Act. An AUP that allows for “flexible” or “exploratory” use of a high-risk system creates significant liability. The policy must be rigid regarding the scope of application.

2. Data Governance and Management Policy

Data governance is the bedrock of AI reliability. The AI Act (Article 10) mandates specific data governance practices for high-risk systems. This policy must bridge the gap between the technical reality of machine learning (where data is often messy) and the legal requirement for “quality” (ISO 8402:1986) and “robustness.” It must also remain compliant with GDPR, particularly regarding the processing of special category data (e.g., biometric or health data).

Training, Validation, and Testing Data

The policy must establish procedures for the separation of datasets. It is insufficient to have a single “training” blob. The organisation must demonstrate, through documentation, that training, validation, and testing datasets are distinct. This ensures that the model’s performance is evaluated on data it has not seen before, providing a realistic measure of its generalisation capabilities.

The policy must mandate statistical analysis of datasets to ensure they are representative of the population they will interact with. The policy should define the metrics for bias detection (e.g., disparate impact ratio) and the thresholds that trigger a halt in deployment.

Handling of Biometric and Special Category Data

If the AI system processes biometric data, the policy must detail the encryption, pseudonymisation, and access control measures in place. A deployer cannot simply claim ignorance if the vendor provided a faulty system. The deployer must perform due diligence to ensure the system is compliant before deployment.

Vendor Due Diligence and CE Marking

The procurement policy must mandate the verification of the Declaration of Conformity and the technical documentation. For high-risk AI systems, the deployer must ensure the system bears the CE marking (or the new AI-specific conformity marking). The policy should require the vendor to provide the “instructions for use” (Article 13) and information regarding the level of accuracy, robustness, and cybersecurity.

Contractual Clauses and Liability

Standard software procurement contracts are often insufficient. The policy must require specific clauses regarding AI liability. These should include:
* Access to Logs: The vendor must provide access to the logs required for post-market monitoring (discussed below).
* **Model Updates:** A procedure for how the vendor handles model updates or “drift.” If the vendor updates the model remotely, does this constitute a new placement on the market? The contract must define the deployer’s right to review changes.
* **Incident Reporting:** The vendor’s obligation to notify the deployer of any serious incidents or malfunctions within strict timeframes (usually defined as “without delay”).

Open Source and Custom Models

Many organisations use open-source models. The policy must address the risk here. If an organisation takes an open-source model and modifies it significantly, it may be considered a “provider” under the AI Act, triggering full conformity obligations. The procurement policy must define the threshold of modification that triggers this reclassification. If the organisation is merely a “deployer” of an open-source model, the policy must still require a risk assessment of the model’s documentation and known limitations.

4. Incident Response and Post-Market Monitoring Policy

Unlike traditional IT security, AI incidents involve “malfunctions” that may not be malicious but result in discriminatory outcomes or safety risks. The AI Act introduces strict reporting obligations that overlap with, but are distinct from, GDPR breach notifications.

Definition of a Reportable Incident

The policy must define what constitutes a “serious incident” as per Article 73 of the AI Act. This is defined as an incident that leads to the death or serious injury of a person, a breach of fundamental rights, or serious damage to property or the environment. However, the policy should also establish a lower threshold for internal logging, such as “significant performance degradation” or “unexpected bias manifestation,” which may not require immediate reporting to the market authority but requires internal remediation.

Reporting Timelines and Channels

There is a strict timeline for reporting. The policy must outline the internal escalation path:
1. Detection: How is the incident identified (via user reports, automated monitoring)?
2. Assessment: A rapid triage to determine if it meets the “serious” threshold.

The policy must specify the minimum data points that must be logged. A robust logging policy for an AI system should capture:

A critical technical requirement is that logs must be immutable. The policy must prohibit the alteration or deletion of logs by operators or the system itself. In the event of a regulatory audit, the integrity of these logs is the primary evidence of compliance.

AI systems are not static. A policy framework that treats AI as a “deploy and forget” product will fail. The AI Act mandates a risk management system that is continuous and lifecycle-based.

The policy must schedule regular internal audits. These are not technical penetration tests, but compliance reviews. They ask: Is the system still being used for its intended purpose? Article 72 of the AI Act requires providers to establish a PMP. This includes monitoring the accuracy and robustness of the system in the live environment. If the accuracy drops below a certain threshold (defined in the Acceptable Use Policy), the system must be taken offline or re-evaluated.

Retirement and Decommissioning

The lifecycle ends with decommissioning. The policy must define the procedure for retiring an AI model. This includes:

* Ensuring that the model is no longer accessible.
* Archiving the technical documentation and logs for the required retention period.
* Notifying users and, if necessary, the market authority of the withdrawal of the system from the market.

Interplay of EU Regulation and National Implementation

While the AI Act is a Regulation (directly applicable in all Member States), it leaves room for national implementation, particularly regarding enforcement and the use of high-risk AI in public sectors.

National Competent Authorities (NCAs)

Each Member State must designate a market surveillance authority. In Germany, this might be the Federal Network Agency (BNetzA) or existing bodies like the Federal Institute for Drugs and Medical Devices (BfArM) for medical AI. In France, it is likely to be the DGCCRF or the CNIL (working in tandem regarding data). Your policies must be aware of which specific authority holds jurisdiction. For example, a biometric system used for access control in a public building in Spain will be subject to the scrutiny of the Spanish Agency for Data Protection (AEPD) and the relevant market surveillance authority.

Public Sector Deployers and Fundamental Rights

Public administrations often use AI in high-stakes scenarios (e.g., social benefit allocation, policing). Many Member States have specific “AI in the public sector” guidelines or laws that are stricter than the AI Act. For instance, the Dutch “Algorithmic Transparency Register” requires public sector algorithms to be registered and explained. A policy architecture for a public institution must include a “Public Register” section, ensuring that the transparency requirements of national open government laws are met alongside the AI Act.

Regulatory Sandboxes

Article 53 allows for “Regulatory Sandboxes”—controlled environments where innovative AI can be tested under regulatory supervision. The policy framework should include a procedure for applying to these sandboxes. This allows the organisation to test its data governance and logging policies in a real-world setting with the regulator’s guidance, effectively stress-testing the policy architecture before full-scale deployment.

The Role of the AI Officer

While the AI Act does not mandate a specific role like the GDPR’s DPO, it implies the need for accountability. The policies should designate an “AI Officer” or a committee responsible for overseeing them. This role is responsible for the “Chain of Responsibility.” They ensure that the Procurement Policy is consulted before a contract is signed, and that the Incident Response Policy is activated when a malfunction occurs.

Training and Awareness

Policies are useless if the staff does not understand them. The Acceptable Use Policy, in particular, must be accompanied by mandatory training. Operators of high-risk systems must understand the limitations of the AI and the importance of human oversight. The Review Procedures should mandate that training records are kept and updated whenever the system or the policy changes.

Documentation as Evidence

In a regulatory audit, the existence of a policy is not enough; the organisation must demonstrate that the policy is lived. The Logging Policy generates the raw data that proves compliance. The Incident Response Policy provides the framework for handling errors. The Procurement Policy proves due diligence. Together, these documents form the “Technical Documentation” required by the AI Act. They are the legal shield of the organisation.
