Yet, the operational reality is governed by a dense web of regulatory obligations that extends far beyond technical performance. Deploying AI in these contexts requires a precise understanding of where the technology sits within the legal taxonomy of the EU, how national implementations diverge, and where the boundaries of acceptable risk lie. This analysis explores the practical application of AI in administrative and pedagogical workflows, focusing on the interplay between efficiency gains, regulatory constraints, and the governance structures necessary to sustain trust and legality.
The Regulatory Taxonomy of Administrative AI
When an institution deploys an AI system to support administrative or pedagogical tasks, the first analytical step is to determine its legal classification. The same applies to AI systems used by public employment services to match job seekers with vacancies, a common administrative workflow. These systems are not merely tools for internal efficiency; they are instruments of public decision-making that directly impact individuals’ rights and opportunities.
Under the AI Act, a high-risk AI system must undergo a rigorous conformity assessment, implement a risk management system, ensure data quality and governance, maintain technical documentation, enable logging, provide transparency information to users, and be subject to human oversight.
The obligation to conduct a conformity assessment before placing such a system on the market or putting it into service rests on the provider. For institutions that develop their own AI tools in-house, they are considered providers and must assume these full responsibilities. If they procure a system from a vendor, they become users but retain significant obligations, particularly regarding human oversight and correct use as specified by the provider.
Systems Not Classified as High-Risk
Many administrative workflows involve AI that does not meet the high-risk threshold. An AI-powered chatbot that answers routine student questions about campus facilities or a system that optimises energy consumption in a university building are examples. These systems are not listed in Annex III and are therefore not subject to the stringent obligations of high-risk AI. However, they are still subject to the general principles for AI systems outlined in Article 5 and the transparency obligations for certain AI systems, such as chatbots, which must make it clear to users that they are interacting with an AI.
The distinction is critical. An institution might assume that a “low-risk” tool requires minimal governance, but the use of personal data within these systems brings them under the purview of the General Data Protection Regulation (GDPR). The efficiency gains from a seemingly benign AI tool for scheduling or email triage can evaporate if the processing of personal data is unlawful, unfair, or opaque.
Data Governance: The Foundation of Legal Compliance
AI systems are data-driven. In administrative and pedagogical contexts, this data is often highly sensitive, encompassing academic records, health information, disciplinary actions, and socio-economic backgrounds. The AI Act explicitly requires that measures be taken to identify and prevent such biases.
This is where the intersection of GDPR and the AI Act becomes complex. While GDPR is harmonised across the EU, national implementations of data access for research and public interest tasks can vary. Some Member States have specific legislation that facilitates the use of administrative data for research purposes, including research that informs the development of AI systems. For instance, the Dutch Wet ruimte voor data (Space for Data Act) aims to make data from public institutions more accessible for innovation and public task performance. In contrast, other countries may have more restrictive interpretations of what constitutes a “public interest” or may impose stricter conditions on data sharing between public bodies. An institution looking to train an AI model on data from multiple sources (e.g., student records, library usage, and sports facility attendance) must navigate this patchwork of national laws.
Practical Workflows: From Admissions to Pedagogy
Understanding the legal framework is essential, but its practical application is best illustrated through concrete use cases. AI is transforming workflows across the administrative and pedagogical spectrum, each with its own risk profile.
Admissions and Recruitment
AI systems are used to screen applications, parse CVs, and even conduct initial video interviews where the candidate’s speech and facial expressions are analysed. The efficiency gains are obvious, especially for large institutions receiving thousands of applications. However, the risks are substantial.
First, the risk of algorithmic bias is high. If an AI system is trained on the profiles of previously successful candidates, it may penalise candidates from non-traditional backgrounds or with atypical career paths. This can lead to indirect discrimination, which is prohibited under EU law. The institution must be able to demonstrate that the tool does not have a disproportionately negative impact on protected groups.
Second, the requirement for human oversight is paramount. The AI Act mandates that high-risk systems be designed to allow for human intervention in a timely manner. In recruitment, this means a human must have the final say. The AI’s role should be to rank or filter, not to reject. The human reviewer must be trained to understand the AI’s limitations and to scrutinise its recommendations critically. They cannot simply “rubber-stamp” the AI’s output.
Third, transparency is a key obligation. Candidates must be informed that they are subject to an automated process. Under GDPR, they have the right to meaningful information about the logic involved in automated decision-making. While the provider of the AI system may protect its intellectual property, the institution using the system must be able to provide a meaningful explanation of the process to candidates who request it.
Student Support and Pedagogical Personalisation
AI is increasingly used to create personalised learning paths and to provide adaptive support. An AI system might analyse a student’s performance on quizzes to recommend specific learning materials or identify areas where they need additional help. This is a powerful pedagogical tool, but it also constitutes profiling under GDPR.
The risk here is not necessarily a formal legal decision, but the significant effect on the student’s educational journey. If an AI system pigeonholes a student as a “low performer” and directs them to less challenging material, it could create a self-fulfilling prophecy, limiting their potential. This is a form of significant effect that engages the protections of GDPR.
From a pedagogical perspective, the governance question is one of validity and efficacy. How does the institution know that the AI’s recommendations are sound? This requires a robust evaluation framework. The AI should be treated as an experimental tool, subject to continuous monitoring and validation by educational experts. The institution must avoid the “black box” problem, where teachers and students are expected to trust an AI’s recommendations without understanding the underlying rationale.
Furthermore, the use of AI for proctoring during online exams presents a particularly contentious area. These systems monitor students via their webcam and microphone to detect potential cheating. They often involve facial recognition and behavioural analysis. This processing is highly intrusive and raises significant data protection concerns. The French data protection authority, CNIL, has issued guidance and sanctions in this area, stressing the need for a clear legal basis and the principle of data minimisation. The AI Act may also classify advanced proctoring systems as high-risk if they are used for the purpose of assessing learning outcomes in a way that has legal effects.
Back-Office Automation
Behind the scenes, AI is streamlining a vast array of administrative tasks. Intelligent Character Recognition (ICR) and Natural Language Processing (NLP) are used to process invoices, grant applications, and official correspondence. Chatbots handle routine inquiries, freeing up staff for more complex tasks. Predictive analytics are used for resource allocation, such as forecasting student enrolment to optimise classroom and staff scheduling.
These applications are often less visible to the individuals affected, but they still carry risks. An error in an automated invoice processing system could lead to suppliers not being paid. A faulty chatbot could provide incorrect information about critical deadlines. A biased enrolment forecasting model could lead to under-resourcing of certain departments or campuses.
The governance challenge here is primarily one of quality control and accountability. Who is responsible when an automated system fails? The institution remains the data controller under GDPR and is liable for any resulting harm. The AI Act’s obligations on logging and human oversight are designed to ensure that there is always a trail of accountability and a human who can step in to correct errors.
Governance and Risk Management in Practice
Compliance is not a one-time event but a continuous process of governance. For institutions deploying AI in administrative and pedagogical workflows, this requires establishing clear internal structures and procedures.
The Role of the AI Officer and Data Protection Officer
While the AI Act does not mandate a specific role like an “AI Officer,” it does require that high-risk AI systems be overseen by natural persons with the necessary competence, training, and authority. This is particularly important for pedagogical applications, where the ethical implications can be as significant as the legal ones.
Impact Assessments: DPIAs and AI-Specific Assessments
Under GDPR, a Data Protection Impact Assessment (DPIA) is mandatory for any processing that is likely to result in a high risk to the rights and freedoms of natural persons. The AI Act introduces a parallel requirement for high-risk AI systems: a fundamental rights impact assessment. While the details of this are still being finalised, it is expected to require providers and deployers to analyse the potential impact on fundamental rights, such as non-discrimination, privacy, and data protection. Institutions should prepare to conduct these assessments in an integrated manner, addressing both data protection and fundamental rights risks simultaneously. The process should involve consulting with relevant stakeholders, including staff, students, and their representatives.
Procurement and the Supply Chain
Most institutions will procure AI systems from third-party vendors. This shifts some of the regulatory burden, but it does not eliminate the institution’s responsibilities. When procuring a high-risk AI system, the institution (as a user) must ensure that the provider has complied with their obligations under the AI Act. This means demanding the CE marking, the declaration of conformity, and the technical documentation.
Procurement contracts must be carefully drafted. They should specify the required level of transparency, the data to be used, the expected performance metrics, and the obligations for human oversight. Crucially, they must address data protection, ensuring that the vendor acts only on the institution’s instructions and provides sufficient guarantees to implement appropriate technical and organisational measures. The institution must also ensure it has the capacity and expertise to actually use the system as intended by the provider. Buying a sophisticated AI tool is of little use if the staff are not trained to oversee it.

The AI Act imposes a continuous obligation on providers of high-risk AI systems to monitor their performance in the post-market phase. For users of these systems in public institutions, this translates into a duty to monitor for drift and unexpected behaviour.
An AI system for student scheduling might work perfectly at the start of the academic year, but as students drop courses or add new ones, the underlying data distribution changes. The system’s performance may degrade, or it may start producing suboptimal or biased schedules. The institution needs a process for collecting feedback from users (staff and students) and for periodically reviewing the system’s outputs to ensure they remain fair and effective. This is not just a technical task; it requires input from administrative and pedagogical experts. When a system needs to be updated or retrained, the institution must consider whether the changes are significant enough to require a new conformity assessment.
